Bye bye Twitpic x
So yet again another service that really doesn’t seem to have taken any thought over it’s users. That, or maybe they were hoping we didn’t notice. Well they have amended their terms and to say they majorly suck isn’t even justice enough. I was going to write a whole post about this and how wrong it is but I found this beauty shepy.co.uk so head on over there for a read.
If you’re just curious what the issue is, amended terms on TwitPic are as follows:
…by submitting Content to Twitpic, you hereby grant Twitpic a worldwide, non-exclusive, royalty-free, sublicenseable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the Content in connection with the Service and Twitpic’s (and its successors’ and affiliates’) business, including without limitation for promoting and redistributing part or all of the Service (and derivative works thereof) in any media formats and through any media channels.
You also hereby grant each user of the Service a non-exclusive license to access your Content through the Service, and to use, reproduce, distribute, display and perform such Content as permitted through the functionality of the Service and under these Terms of Service. The above licenses granted by you in media Content you submit to the Service terminate within a commercially reasonable time after you remove or delete your media from the Service provided that any sub-license by Twitpic to use, reproduce or distribute the Content prior to such termination may be perpetual and irrevocable.
Essentially, they own everything you put on there, they can use it for whatever they want, as can their associates and affiliates businesses’, even after you delete your photos!
If you want to easily transfer your images to posterous there is a link here http://posterous.com/switch/twitpic
TwitPic has since posted this information, saying that isn’t the case, http://blog.twitpic.com/2011/05/your-content-your-copyrights/ but I notice they do not provide a link to where in their terms it explains that.
